Terms of service

Last updated: [TODO: publication date]

These terms apply to businesses that use FlashReplai ("you"). FlashReplai is run by [TODO: full legal name], an independent developer, at [TODO: contact address] ("we"). By using the service, you agree to these terms. If you've signed a separate agreement with us, that agreement takes priority where the two differ.

1. The service

FlashReplai is an AI assistant that replies to your customers on WhatsApp using the information you give us, records their requests, and passes conversations to your team through a web dashboard and a Telegram bot. We set it up with you and agree on the best way to connect your WhatsApp number. We may improve or change features over time, and we'll tell you in advance about any change that affects how you use the service.

2. Free trial

New clients get a 14-day free trial. After the trial, you need to subscribe to a plan to keep using the service.

3. Your content and your customers' data

4. Acceptable use

You agree not to use FlashReplai to:

If you break these rules, we may suspend the service after warning you, or immediately if there's a serious risk to your customers, to WhatsApp numbers, or to the service.

5. AI replies can be wrong

The assistant answers only from your information and passes conversations to your team when it doesn't know. Even so, AI can misunderstand a message or give an incorrect or incomplete answer. You stay responsible for the replies sent to your customers and for any decisions or commitments made with them, and you should review conversations regularly. Don't rely on the assistant alone for urgent matters, or for medical, legal or financial advice.

6. The WhatsApp connection

The service also depends on other providers, and these can go down. We'll do our best to keep the service running and to help if something goes wrong, but we're not responsible for the actions or outages of WhatsApp, Meta or other providers.

7. Fees

Fees depend on your plan and message volume, plus a one-time setup fee, and are set out in the quote we send you. [TODO: whether the one-time setup fee applies after the trial, and whether it is refundable] Plans are billed monthly and paid in advance, by the methods we agree on, such as InstaPay, bank transfer, Vodafone Cash or Fawry. [TODO: what happens when the monthly reply limit is reached]

8. Ending the service

9. Limitation of liability

We provide the service with care, but we can't promise it will be free of errors or interruptions. To the extent the law allows, we're not liable for indirect losses such as lost profits, lost customers or lost data, and our total liability is limited to the fees you paid us in the 3 months before the claim. Nothing in these terms limits liability that can't be limited by law.

10. Changes to these terms

If we change these terms, we'll tell you at least 30 days before the change takes effect. If you keep using the service after that, you accept the new terms.

11. Governing law

These terms are governed by [TODO: governing law, for example the laws of the Arab Republic of Egypt], and disputes go to [TODO: competent courts or arbitration]. If the Arabic and English versions differ, [TODO: which version prevails].
